"WARSAW, N.Y. (WIVB) - A man is in custody, after the Wyoming County Sheriff’s Office says he changed his last name the day before his scheduled sentencing and then did not appear in court. In September, 25-year-old Eric Motzer was convicted of second-degree criminal sale of marijuana, endangering the welfare of a child, second-degree rape and second-degree criminal sexual act. He was scheduled to be sentenced on September 22nd. However, on September 21st, he was married in front of a Genesee County Justice of the Peace, and took the name Eric Disalvo. The following day, Motzer/Disalvo did not appear in court and a warrant was issued for his arrest.
The man was apprehended in West Virginia, where the Wyoming County Sheriff’s Office say he fought extradition stating his name was not Eric Motzer.
After several hearings and a governor’s warrant issued, the man was transported back to New York. An was arraigned in Wyoming County Court, and remanded without bail.
He will face sentencing for the original charges on April 5th."
Crime is nothing but misdirected energy! But, speaking of misdirection, how was Eric Mozer OUT ON BAIL, KNOWING THAT HE WILL BE SENTENCED FOR CRIMINAL SALE OF MARIJUANA, ENDANGERING THE WELFARE OF A CHILD, SECOND DEGREE RAPE AND SECOND DEGREE CRIMINAL SEXUAL ACT???!!!! We have all seen the explosion of police presence on all levels of government since 2001 -- everywhere except, apparently, Wyoming County -- where a convicted rapist gets to have a vacation prior to his sentence, get married, change his name and take off to West Virginia. I don't know who the Judge and Prosecutor are in Wyoming County, but you have to wonder why this guy was out of jail in the first place. Must be that they thought he was a sweetheart as did his new wife, who apparently was not put off by the pot, endangering the welfare of a child, rape and criminal sexual act charges. And in the mix is the accomodating Justice of the Peace. How does Eric get his name changed by a justice of the peace???. This story needs a bit more light.

ReplyDeleteHi, I actually know Eric Motzer...Unfortunately....He USED to be my best friend during elementary school. We met again after I graduated from high school, finding out that he lived next door to me in an apartment. My mom and I gave him money, since he asked, but we never knew what the reason was. We found out some months later that not only was he doing drugs, but was actually raping other women as well! I felt so heartbroken and betrayed by that slimeball, because we used to be a couple for a short while! I'm glad that we never took it a step further, or I wouldn't have found out about his sick acts!
ReplyDeleteWhat I find the most interesting about this is the fact that no one wants to acknowledge the fact that Eric was first offered probation which he refused as he still refuses to except guilt for crimes he didn't commit. About a year after he was finally sent upstate he finally received his discovery and Brady materials containing the "victim's" statement saying they'd never had sex but if she could have had sex with him she would have. Eric has since good on to get his sentence modified at appeal and is now working on a 440.10 motion to get the original trial over turned and a new trial issued as his own defense attorney withheld the evidence from his own client that showed his innocence. Nor has Eric ever been accused prior to nor after of raping anyone. Add to this the fact that the original indictment was changed so the victims own father couldn't testify as Eric's alibi witness if anything someone needs to investigate the corruption in the Wyoming county police apartment and D.A.'s office as to how am innocent man, a father of 3 that was working and going to school could be sent to prison for 14 years with 20 post for a crime he never committed and why it's taken almost a decade for him to be able to make it back to the court's to clear his name. Can someone explain that to me?
ReplyDeleteI know eric, He is scum. I so believe he touched his daughter at a young age but she was only 5 at the time and she would just shut down and not talk so nothing happened to him. Eric has been in prison or jail more than in his kids lives. I think its funny that his mother would allow her rapist son around the kids, but she is no better then he he is. What gets me is that this is not the 1st time he fled out of state, he did before while on probation. you would think they would know he is/was a flight risk.
